To be able to compile and evaluate all answers on “Buy-in” in an efficient way, we would appreciate if all members could take the time to give this topic some attention. Please note that we would like the feedback to reflect the member firms’ collective view rather than a specific person’s personal view. Generally, we will follow our members’ collective view. However, OMX, Oslo Børs and ICEX still reserves a final decision for exceptional circumstances.


We need your answer no later than 15 December, 2006. If you are indifferent about some questions please leave those blank.
All answers will be distributed to all members unless you prefer your answers to be confidential.

1. Implementing “buy-in rules” on the equity market

Should there be a fixed maximum cost (ceiling) for the buy-in attempt (s)

Maximum cost for buy-in attempt is last official closing price +50% and ceiling for buy-in related premium is 100 000 EUR, 1 000 000 SEK/DDK/NOK and 10 000 000 ISK.

No, we do not support implementation of fixed maximum cost for buy-in; buy-in cost is based on market price of securities plus included transaction costs.

3. Cash Settlement price

If all buy-in attempts are failed during 20 banking days following the buy-in notification, should there be a fixed maximum cost (ceiling) for cash settlement?


Yes, we support fixed cash settlement cost (NOREX proposal)

Fixed cash settlement cost is original trade +50% and ceiling for buy-in related premium is 100 000 EUR, 1 000 000 SEK/DDK/NOK and 10 000 000 ISK.
