CORRIGENDUM

Sub: Charging for privately owned BCBFG wagons.( Corrigendum to Rates Circular No. 56 of 2008)



Ref: Board’s letter of even number dated 13.10.2008 (Rates circular No.56 of 2008)
1.0 In terms of Board’s letter of even number dated 13.10.2008 (Rates circular No.56 0f 2008), instructions have been issued for charging of BCBFG wagons privately owned by M/s Adani Agri Logistics Ltd.
2.0 In partial modification of para 3.0 of Rates Circular No.56 of 2008, it is advised that for the purpose of granting trainload rate benefit, the standard rake size for BCBFG wagons will be 50 wagons and minimum number of wagons required to be loaded will be 47 wagons, with immediate effect.
3.0 Further to above, it has also been decided that following guidelines will be applicable from the day of commissioning of operation of BCBFG rakes (i.e. 14.10.2008) owned by M/s Adani Agri Logistics Ltd:
3.1 Empty haulage charges for empty haulage of these wagons is not leviable for movement from the unloading point back to loading point.
3.2 The issue of charging of empty haulage charges for maintenance is under consideration and final decision in the matter will be advised in due course. In the meantime, Railway shall take an undertaking from the customer that the decision taken by Ministry of Railways in this regard will be binding on them and haulage charges levied, if any, will be payable by them.
3.3 The maintenance charges will be levied as applicable for other privately owned wagons.
3.4 Engine hire charges will be leviable for detention of engine after granting free time prescribed for loading and unloading of hopper wagons under Engine-on Load concept. Presently, free time for loading and unloading has been prescribed as 3 hours and 2 hours respectively, vide Board’s letter No.2005/TC(FM)/1/8 dated 06.03.2006 (Freight Marketing Circular No.9 of 2006).
3.5 The rates of engine hire charges will be same as notified by Ministry of Railways from time to time. The latest instruction in this regard has been issued in terms of Rates Circular No.18 of 2008.
3.6 Shunting charges shall not be leviable.
3.7 Stabling charges will be levied as per the extant instructions laid down in Rates Circular No.97 of 2006 issued by Ministry of Railways and as amended from time to time.
3.8 If commercial staff are posted by Railway exclusively for the siding, the extant siding rules for recovery of staff cost should be applicable. However, if the staff are not posted exclusively for the siding, no staff cost will be levied.
3.9 Since the wagons as well as sidings are privately owned, Demurrage charge and Wharfage charge shall not be leviable.
3.10 The instructions regarding weighment and reweighment issued from time to time, shall be applicable on these wagons. Reweighment of already weighed rakes at en-route/destination should not be done normally.
4.0 All Commercial Instructions issued for dealing with goods traffic, including that for private siding, shall be applicable to the extent they are not contrary to the instructions prescribed in these instructions.
5.0 This issues in consultation with Traffic Transportation and Mechanical Engineering Directorates and with the concurrence of Finance Directorate of the Ministry of Railways.

AMENDMENT No.3

Sub: RATIONALISATION SCHEME GENERAL ORDER No. 1/2008-thereto

Ref: LRA No. 68, 74 & 111 of 2008 (Goods) dated 18.6.08,30.6.08 & 17.9.08
Refer Board’s Circular letter of even number dated 11.6.2008, 13.6.08 & 9.9.08 issuing Rationalisation Scheme General Order No. 1/2008 and amendments thereto. Now as it is necessary so to do in the public interest, the Para No. 3-A.1 under North Eastern Railway of said General Order No. 1/2008 may be modified as under:-

Sub:- Hub and spoke system for CONCOR
Container Train Operators are permitted to operate Hub and spoke system for transportation of containers as per Railway Board’s letter No. 2008.TT-III/73/8 dated 1.7.2008.
The list of hubs and the connected originating and terminating stations as below are notified as hub for CONCOR.
The system of documentation and calculation of haulage charges for the list of hub as enclosed is permitted for CONCOR w.e.f 1.8.2008 for one year as per Railway Board’s letter No. 2008/TT-III/73/8 dated 1.7.2008.

This issues with the concurrence of Finance Directorate in the Ministry of Railway.
