Mr. George Shaw called the pre meeting to order.

Chairman Burns called the meeting to order.




  1. INVOCATION

Jasper Lee gave the invocation.




  1. PLEDGE TO THE FLAG

Chairman Burns led the pledge.




  1. AGENDA APPROVAL

Chairman Burns asked if there were any changes to the agenda. Mr. George Shaw confirmed there were no changes. Chairman Burns called for a motion to approve the agenda as read. Peter Higgins made a motion to approve the agenda. Alphonso Giles seconded the motion. The motion carried by unanimously.




  1. APPROVAL OF MINUTES

Chairman Burns asked if there were any corrections or additions to the September 28, 2009 meeting minutes. There being none, Jasper Lee made a motion to approve the minutes as read. Peter Higgins seconded the motion. The motion carried by unanimously.

Persons Attending: Ms. Patricia Rutledge, Prophetess Roberta S. Satney, Mr. Toss Allen, Mr. Rickey Kicklighter, Mr. William Hinely, Ms. Omie Hinely, Ms. Jean E. Roddenberry and Mr. Sammy Roddenberry
VIII. PUBLIC HEARING
Chairman Burns stated all items voted on would be presented at the November 17, 2009 Board of Commissioners meeting as a public hearing (with the exception of residential business and pond requests)

Jacquelyn W. Hedlund – Public Hearing (1): The applicant request to rezone 3.53 acres Map # 262 Parcels# 11 located off of Nixon Chapel Road from AR-2 to AR-1 (Third District)
Ms. Patricia Rutledge approached on behalf of the applicant. Ms. Rutledge stated the request is to combine to reduce the property taxes.
Prophetess Roberta S. Satney asked the property be rezoned for relief of the tax burden.
George Shaw affirmed a letter being written by the property owner requesting the properties be rezoned.
Jasper Lee made a motion to approve the request with the following stipulations:

  1. Parcel 262-11 shall be combined with 262-12 to meet the requirements of the AR-1 zoning district.

  2. Site development plans shall comply with the Effingham County Water Resources Protection Ordinance and the Storm Water Management Local Design Manual.

  3. All wetland impacts shall be permitted by the USACE.

  4. Subdivision plat shall be approved by the Health Department and the Zoning Office.

The motion was seconded by Tim Uzupan. The motion carried unanimously.

EMC Engineering Services, Inc. – Public Hearing (2): The applicant request to rezone 29.47 acres Map# 446 Parcel# 7 located at 1204 Mill Pond Road from R-1 to I-1 (Fourth District)
Toss Allen of EMC Engineering Services, Inc. presented the request. Mr. Allen stated the property was previously rezoned for a residential development and would now like to rezone it to industrial in conjunction with surrounding properties. Mr. Toss Allen confirmed water and sewer services would be provided by the City of Springfield.
Mr. Rickey Kicklighter declared he would be marketing the property for industrial use.
Mr. William Hinely expressed concern for the size of the complex, buffering and the type of business.
George Shaw confirmed the building size proposal to be approximately 250,000 square feet with 150 feet undisturbed buffer.
Tim Uzupan made a motion to approve the request with the following stipulations:

  1. Each lot shall meet the requirements of the I-1 Zoning District.

  2. Site development plans shall comply with the Effingham County Water Resources Protection Ordinance and the Storm Water Management Local Design Manual.

  3. All wetland impacts shall be permitted by the USACE.

  4. Subdivision plat shall be approved by the Health Department and the Zoning Office.

  5. Use shall be made known prior to development plan review to determine proper buffer size.

The motion was seconded by Peter Higgins. The motion carried unanimously.

Sammy H. & Jean E. Roddenberry – Public Hearing (3): The applicant request to rezone 1.75 acres Map# 462 Parcel# 47 located off of Barney Road from AR-1 to AR-2 (Fourth District)
Sammy and Jean Roddenberry requested to rezone their property to give to their grandson to build a home.
No one spoke in favor or against the request.
Tim Uzupan made a motion to approve the request with the following stipulations:

  1. Each lot shall meet the requirements of the AR-2 Zoning District.

  2. Site development plans shall comply with the Effingham County Water Resources Protection Ordinance and the Storm Water Management Local Design Manual.

  3. All wetland impacts shall be permitted by the USACE.

  4. Subdivision plat shall be approved by the Health Department and the Zoning Office

Alphonso Giles seconded the motion. The motion carried unanimously.

Effingham County – Public Hearing (4): The applicant request to amend sections 5.8- (Neighborhood Commercial District), 5.9- (General Commercial District), 5.10 – (Highway Commercial District), 3.19 (Living units in zones other than residential), 3.4 (Buffers), and 3.30.5 (Parking lot improvements required) of the Effingham County Zoning Ordinance.
Mr. George Shaw stated the amendments are being made to coincide with the Comprehensive Growth Plan.
No one spoke in favor or against the request.
Jeff Wilkes made a motion to approve the request. Jasper Lee seconded the motion. The motion carried unanimously.
Effingham County– Public Hearing (5): The applicant request to amend Section 5.4 (R1-A Zoning District) of the Code of Effingham County Zoning Ordinance.
Mr. George Shaw stated parts of the ordinance were conflicting with the building codes.
No one spoke in favor or against the request.
Jasper Lee made a motion to approve the request. Samuel Golden seconded the motion. The motion carried unanimously.
IX. ADJOURNMENT
The meeting adjourned at 7:34:43 pm.
